On 07th May 2021, the Bundestag decided that clubs and live music venues should no longer be defined as places of entertainment, but as facilities for cultural purposes in the Building Use Ordinance.
According to the Club Commission, this is thanks to years of work by LiveKomm, the Federal Association of Music Venues and the Parliamentary Forum Club Culture and Afterlife. The latter was founded by members of the Bundestag in early 2020 to secure and support club culture.
Previously, clubs were put on an equal footing with amusement arcades, betting offices, sex cinemas and brothels in the Building Use Ordinance, grouped together as places of entertainment. These are not permitted in mixed and core areas and urban and residential areas for building planning purposes.
Now clubs, by virtue of being cultural facilities, are on an equal footing with theatres, operas, museums and concert halls. This means that new venues for club culture and live music can now be created, as more locations for venues can be considered. In addition, the role increases due to the new locations in urban development, but also due to the cultural status in urban development.
